ACKNOWLEDGMENT OF RISK
Pilates and other studio activities involve physical exertion and risks including soreness, strains, sprains, falls, dizziness, aggravation of medical conditions, equipment-related injury and, rarely, serious injury, disability or death. I voluntarily participate and knowingly assume these risks.
HEALTH & MEDICAL RESPONSIBILITY
I am responsible for determining whether I can safely participate and for informing my instructor of injuries, pregnancy, surgery, medical conditions, limitations or medication effects. Sanctuary Pilates does not provide medical advice, diagnosis or treatment. I will stop and notify the instructor if I experience unusual symptoms.
EQUIPMENT & INSTRUCTOR GUIDANCE
I will follow studio safety procedures and instructor directions and use equipment only as instructed. Instructors may provide verbal, demonstrated or hands-on cues; I may decline physical adjustments at any time.
ASSUMPTION OF RISK
I knowingly and voluntarily assume the inherent risks of classes, private or semi-private sessions, workshops and other studio programs. No exercise program can be guaranteed free from risk.
RELEASE — INCLUDING ORDINARY NEGLIGENCE
TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, I RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE SANCTUARY PILATES STUDIO, LLC, SANCTUARY PILATES, AND THEIR OWNERS, MEMBERS, MANAGERS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AGENTS, REPRESENTATIVES, SUCCESSORS, ASSIGNS AND, WHEN APPLICABLE, LANDLORDS OR PREMISES OWNERS (THE “RELEASED PARTIES”) FOR CLAIMS FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR OTHER LOSS ARISING FROM OR RELATED TO MY PARTICIPATION, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. This release does not waive liability that cannot lawfully be waived.
STUDIO RULES; PROPERTY; EMERGENCIES
I will follow studio rules, safety procedures and equipment instructions and report damaged equipment. I am responsible for my belongings. If I cannot communicate during a medical emergency, I authorize studio personnel to contact emergency services and my emergency contact. I am responsible for resulting medical expenses to the extent permitted by law.
FLORIDA LAW; SEVERABILITY; VENUE
Florida law governs this agreement. If any provision is unenforceable, the remainder remains effective to the extent permitted by law. To the extent legally enforceable, venue shall lie in a court of competent jurisdiction in the Florida county where Sanctuary Pilates Studio, LLC principally operates.
ELECTRONIC SIGNATURES
This agreement may be executed electronically. To the extent permitted by applicable law, an electronic signature or record is intended to have the same legal effect as a handwritten signature or paper record.
